Terms of Service

These Terms of Service ("Terms") govern your use of the PeekAPI platform operated by PeekAPI ("we", "us", "our"). By creating an account or using our service, you agree to these Terms.
1. Service Description
PeekAPI is an API analytics platform. Our SDKs integrate with your API servers to collect request metadata (method, path, status code, response time, consumer identifier). This data is displayed in a real-time dashboard with charts, tables, and configurable alerts.
2. Accounts
You must be at least 16 years old to use PeekAPI. You must provide a valid email address and create an organization to use the service. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately if you suspect unauthorized access to your account.
All activity under your API key is attributed to your account, including activity from compromised keys. You must revoke compromised keys immediately via your dashboard settings.
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to gain unauthorized access to the service or its infrastructure
- Send data that contains malware, viruses, or harmful code
- Circumvent usage limits, rate limits, or other restrictions of your plan
- Resell or redistribute access to the service without authorization
- Use the service to collect or transmit personally identifiable information (PII) of end users without their consent
4. Plans and Pricing
PeekAPI offers multiple plan tiers (Free, Pro, Business, Enterprise) with varying event limits, SDK quotas, data retention periods, and support levels. Current pricing is listed on our website and may change with 30 days notice. Paid plans are billed monthly or annually. All payments are processed by Paddle, our merchant of record.
Events exceeding your plan's monthly limit are throttled (dropped without ingestion). Paid plan subscribers may configure a hard cap or opt in to overage billing at their published per-event rate from their dashboard settings. No overage charges are incurred unless you explicitly enable overage billing.
5. Cancellation and Refunds
You may cancel your paid subscription at any time from your dashboard settings. Upon cancellation, your plan remains active until the end of the current billing period. No partial refunds are issued for unused time within a billing cycle.
If you are a new subscriber and are not satisfied with the service, you may request a full refund within 14 days of your first paid subscription by contacting [email protected]. This 14-day money-back guarantee applies only to the first subscription payment and does not apply to renewals or plan upgrades.
Refunds are processed to the original payment method within 5-10 business days. We reserve the right to deny refund requests in cases of abuse or violation of these Terms.
6. Data Ownership
You retain ownership of all data you send to PeekAPI. We do not claim any intellectual property rights over your data. We have a limited license to process, store, and display your data solely to provide the service. Upon account termination, your data will be deleted in accordance with our Privacy Policy retention schedule. A 30-day grace period applies after termination before permanent deletion.
7. Privacy
Our collection and use of data is governed by our Privacy Policy, which is incorporated into these Terms by reference. For customers subject to GDPR or similar data protection regulations, a Data Processing Agreement (DPA) is available upon request at [email protected] or can be reviewed at our DPA page.
8. Intellectual Property
The PeekAPI platform, documentation, and brand are owned by PeekAPI and protected by applicable intellectual property laws. Our SDKs are provided under the MIT License. All other open-source licenses are specified in their respective repositories.
9. Availability, Uptime SLA, and Support
We strive to maintain high availability for all plans. Planned maintenance will be communicated in advance. Support response times vary by plan tier. We reserve the right to modify, suspend, or discontinue features with reasonable notice.
Uptime commitment. PeekAPI targets 99.9% monthly uptime for the dashboard and ingestion endpoints for Business plan subscribers, and 99.95% for Enterprise plan subscribers. Uptime is measured as the percentage of minutes in a calendar month during which the service is available, excluding scheduled maintenance windows announced at least 24 hours in advance.
Service credits. If monthly uptime falls below the committed level, affected Business and Enterprise subscribers may request service credits by contacting [email protected] within 30 days of the incident. Credits are calculated as follows:
- Below 99.9% but above 99.0%: 10% credit of that month's subscription fee
- Below 99.0% but above 95.0%: 25% credit of that month's subscription fee
- Below 95.0%: 50% credit of that month's subscription fee
Service credits are applied to future invoices and do not exceed 50% of the monthly subscription fee. Credits are the sole and exclusive remedy for downtime. Free and Pro plans are provided on a best-effort basis without uptime guarantees.
10. Limitation of Liability
To the maximum extent permitted by law, PeekAPI is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of data, revenue, or business opportunities. Our total liability is limited to the amount you paid us in the 12 months preceding the claim, with a minimum of $100.
11. Suspension and Termination
We may suspend or terminate your account if you violate these Terms or engage in activity that threatens the security or integrity of the service. You may close your account at any time from your dashboard settings. Upon termination, your data will be deleted according to our retention policy after a 30-day grace period.
12. Indemnification
You agree to indemnify, defend, and hold harmless PeekAPI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the service or data you transmit through it
- Claims from your end users related to data collected via our SDKs
- Your violation of these Terms or applicable law
- Your misuse of the service or unauthorized use of your API keys
13. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state and federal courts located in Wilmington, Delaware. Both parties consent to the personal jurisdiction of these courts.
Class action waiver. You agree to resolve disputes with PeekAPI on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.
Small claims exception. Either party may bring an individual action in small claims court if the claim qualifies.
14. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, government actions, cloud provider outages, internet disruptions, or power failures. The affected party must notify the other party promptly and use reasonable efforts to mitigate the impact.
15. Export Controls
You agree to comply with all applicable export control laws, trade sanctions, and embargo regulations in your jurisdiction. You may not use the service in violation of any applicable sanctions or embargo, or in any country or territory that is subject to a comprehensive trade embargo.
16. Beta Features
PeekAPI may offer beta or preview features from time to time. Beta features are provided "as is" with no uptime guarantee, reduced SLA, and no liability for data loss or service interruptions. We may modify or discontinue beta features at any time without notice. Your use of beta features is voluntary and at your own risk.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice in the dashboard at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
18. General Provisions
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and PeekAPI regarding the service.
Assignment. PeekAPI may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
